Law no. 2015-990 for growth, activity and equal economic opportunities of 6 August 2015 introduced a tariff for determining the amount of emoluments and flat-rate reimbursements due to notaries for their services subject to regulation. Decree no. 2016-230 of 26 February 2016 specifies the list of services subject to this tariff. An order dated the same day sets the regulated tariff for notaries and can be accessed at www.legifrance.gouv.fr. Customers retain the guarantee of a public tariff and predictable, transparent remuneration. The notary's fee is proportional to the amount of capital for property sales, gifts and inheritance declarations. A flat-rate fee remains applicable for the main family acts, such as marriage contracts or deeds of notoriety. This rate results in a general reduction in notaries' fees of around 1.40% for all acts subject to a flat-rate fee. The amount of the notary's fees may now not exceed 10% of the value of the property or right involved in the transfer, with a minimum of €90.
